These are among the most tightly governed housing arrangements in Florida — covenants, architectural review, and detailed rules about what may be kept on a property.
Deed restrictions do not override federal or state accommodation law. The Fair Housing Act and Florida Statute §760.27 apply to deed-restricted communities as they do to conventional rentals, so a covenant prohibiting animals does not automatically defeat a reasonable accommodation request.
What the statute permits is narrow and worth knowing precisely. Where a disability is not readily apparent, the housing provider may request reliable information reasonably supporting that a disability exists. Where the need for the animal is not readily apparent, they may request reliable information supporting the need for that particular animal. That is the extent of it — they cannot require a specific form or notarisation, and where an accommodation is granted they cannot levy pet fees or additional rent.
Seasonal residency and documentation
Palm Beach County has a substantial part-year population, and that creates a wrinkle specific to this area.
Accommodation requests are often made at the start of a season, sometimes to a community the resident has not lived in for months. A letter written by a provider who saw you once, two years ago, in another state, is thin. Documentation is strongest when it reflects a current clinical relationship.
Where care is ongoing rather than a single transaction, documentation reflects an actual course of treatment. Provided you are physically located in Florida at the time of each appointment, that relationship continues across the year.

The letter is written by Chabellys Payares, MSN, APRN, PMHNP-BC, board-certified and licensed in Florida. It states that you are under a licensed provider's care, that you have a condition affecting a major life activity, and that the animal helps with a limitation arising from it. It does not disclose your diagnosis, which is not required.

What you may be wondering.
Does a deed restriction or 55+ community rule override an ESA accommodation? No. Fair Housing obligations and Florida Statute §760.27 apply to deed-restricted and age-restricted communities. A covenant prohibiting animals does not by itself defeat a reasonable accommodation request, though a provider may still deny one where the specific animal poses a direct threat to health, safety or property that cannot be addressed another way.
I live here part of the year. Does that affect my request? It does not change your rights, but it can affect how strong your documentation looks.
