My condo board has a weight limit — does that apply to an ESA? A reasonable accommodation request is assessed differently from a pet application, and blanket pet rules including weight and breed limits are not automatically applied to an approved accommodation. A housing provider can still deny a request where the specific animal poses a direct threat to health, safety or property that cannot be addressed another way. No provider can guarantee how a particular board will decide.
Can my HOA charge a pet deposit for an emotional support animal? Under Florida Statute §760.27, where an accommodation is granted the housing provider cannot charge pet deposits, pet fees or additional rent for the animal. Ordinary deposits for damage that any resident would pay are unaffected.
Do I have to use my building's own form? No. Florida law specifically provides that a housing provider cannot require a particular form or a notarised document. Some buildings supply one anyway, and it is usually simplest to submit both that and the clinical letter.
